Artist Sues Apple For Use of Her Eye in Marketing Their Retina Display

Apparently feeling like she’d been poked in the eye, Swiss photographer Sabine Liewald is suing Apple over their use of her photograph of said optical organ that they used in their marketing materials and during a keynote presentation.

The eye in question, featured above, was captured by Swiss photographer Sabine Liewald, and while she gave Apple permission to use the high-resolution image, she says it was only for testing some layouts. When the image showed up in Apple marketing material, and at an Apple keynote, she was a bit miffed.

She’s suing Apple over the issue, and she is not just claiming damages for copyright infringement; she is also demanding “actual damages including defendant’s profits.” Considering how much Apple brings in each fiscal year, we’re talking about a lot of Visine here folks.

This is a case that bears watching, and we’ll be sure to keep an eye out for any future developments.
