If you’re planning on an extended legal battle against Apple, you’d better have a large battlechest to draw from, as it can be an expensive endeavor. Medical technology company Masimo has been fighting Apple in court since 2020, and while the company has seen some victories, it hasn’t been a cheap battle.
Masimo’s quarterly earnings report shows how much Masimo has spent fighting Apple in court.
Masimo’s ITC case against Apple began in 2021 over the Apple Watch’s blood oxygen monitoring feature, which ultimately led to an Apple Watch import ban. Apple was forced to remove blood oxygen monitoring from Apple Watches sold in the U.S. in December 2023. That Masimo victory didn’t come cheap, as the firm spent $5.5 million on litigation expenses in 2021, then $28.7 million in 2022, over $40 million in 2023, and $70 million in 2024.
Masimo spent $19.7 million in the first quarter of 2025, and $24 million during the second quarter on litigation. The company is likely to spend more on the court battle in the near future.
Currently, Masimo is embroiled in the appeals process with Apple, as Apple launched an appeal in late 2023. Apple recently argued its appeals case in front of a three-judge panel, though no decision has yet been handed down.
While Masimo’s legal spending includes the costs of other lawsuits, the Apple lawsuit is the firm’s biggest legal battle and it likely accounts for the lion’s share of Masimo’s legal spending.
