Apple’s Schiller To Provide Further Testimony to Samsung in Post-Trial Deposition

An order filed on Thursday reveals that Samsung will be allowed to question the Apple Senior Vice President of Worldwide Marketing Phil Schiller for up to three hours. The deposition is expected to cover matters associated with the request by Apple to ban products a jury found violated its patents.

The order, first reported by The Verge, is meant to offer clarity on comments made by Schiller in his support of the Samsung product ban, some of which were “new or in conflict with his testimony at trial,” the Korean company claims.

Samsung had taken issue with a number of assertions by Schiller, in particular those relating to the Galaxy product lineup.

The court had granted Apple’s own request to depose four expert witnesses as it seeks the injunction, but the order also allows Samsung’s counter motion to question witnesses of its own, including Schiller.

Apple’s subsequent motion on Tuesday sought to “clarify” the courts order. The motion suggested that Schiller was not an expert witness and should therefore be exempt from deposition proceedings. 

Schiller’s deposition will take place no later than November 5th, and can last for no more than three hours.
